MLRD has asked that we confirm
with the Water Quality Control Division that we are correct in
describing as non-point source discharge the runoff from areas of
the property with (under the MLRD regulations) "Small Area
Exemptions. "
Under the MLRD regulations drainage from areas affected by surface
coal mining operations is not required to be passed through
sediment ponds and treatment facilities where:
g4.05. 2(3) . . .the disturbed surface drainage area within
the total disturbed surface area is small and
there is no mixture of surface drainage with a
discharge from underground mine working;
The areas under review are located at various sites around the mine
permit area, consist of less than 1 acre in size, and have no
contact with mine discharge. Calculations of sediment contribution
from these areas, (derived from the universal soil loss equation)
demonstrate that runoff from these areas contributes minimal
sediment.
Area Size Tons
Annually
1 0.12 0.23
2 0.08 0.10
3 0.62 3.60
4 0.44 1.52
