Although final volumes have not been finalized, it is estimated that between 20,000 and 30,000 <br /> cubic yards of refuse will be cut from the Old Refuse Pile. This material will be transported to the <br /> vicinity of the Wash Plant to be stacked upon the concrete rubble generated from the facilities <br /> area demolition. You may note that the concept of burying the concrete rubble with coal refuse <br /> was described in some detail in the Mid-Continent Resources permit application. <br /> You may also have noted that our submittal of January 23, 1998 to your attorney Ed Mulhall of <br /> Delaney and Balcomb did not contain a cost for burying the concrete rubble. It is our intent to <br /> accomplish this at no cost to Resources as a result of excavating material from the Old Refuse <br /> Pile and placing it on the rubble. Completion of this project as envisioned will obviously result in <br /> a substantial savings to the estate, in that the cost of burial is to be paid through completion of the <br /> Huntsman Project, rather than from the Reclamation Fund of the Bankruptcy Plan. <br /> In order to ensure the feasibility and success of the project, we will need to utilize topsoil to cover <br /> the cut slope at the refuse pile. The Division would like your written permission to utilize the <br /> topsoil stockpiled near the eastern terminus of the former overland conveyor. The volume of <br /> topsoil estimated in the Mid-Continent Resources permit to be in this stockpile should be <br /> sufficient to accomplish this project. It is our estimation that the volume of topsoil left in the <br /> Sutey stockpile is sufficient to accomplish reclamation of the mine facilities area, without relying <br /> upon the material at the overland conveyor location. <br /> We look forward to your approval of the use of the topsoil at your earliest convenience. <br /> Sincerely, <br /> Steven G.
