The following should be addressed in a <br /> detailed report, which will likely be evaluated by opposing counsel as a part of on-going <br /> litigation. <br /> - Evaluate the potential for eventual success of the 1997 Mine 4 Steep Slope Revegetation <br /> project; <br /> - Evaluate the potential for success of the 1998 Steep Slope Revegetation Project (which was not <br /> begun), and evaluate the methodology proposed in the Invitation and Bid. These evaluations are <br /> to be based upon observations of the steep slope revegetation work accomplished at Mine 1 and <br /> adjacent to Road D in 1996. Work in these two areas was accomplished using methods similar <br /> to those required in the 1998 Invitation and Bid. <br /> - Evaluate the cost bid to accomplish the 1998 steep slope revegetation project. <br /> - Comment on the necessity to undertake the steep slope revegetation work proposed in the 1998 <br /> steep slope project, including an opinion of whether it is a required reclamation project under the <br /> Mid-Continent permit application and/or applicable reclamation statutes. These comments <br /> would be based upon permit documents, studies undertaken by IMS in the late 80's,regulatory <br /> requirements and ecologic considerations. <br /> - Reflect upon and rebut the comments of MCR consultants which have been relied upon by <br /> MCR as a basis for objecting to the 1998 steep slope revegetation project. <br /> Cheryl Linden, our Assistant Attorney General, requests that you be able to provide an expert <br /> opinion of the items addressed, including the likelihood of success of the proposed steep slope <br /> revegetation, whether you consider the work accomplished in 1997 and that proposed in the 1998 <br /> steep slope revegetation bid package `experimental', and whether you consider vegetation on the <br />
