As was with Pr -06, you have <br />accepted and posted letters for the new permit application and have allowed for those letters to <br />contain personal attacks of rite and other fanners. None of these miners have ever read Pr -06 or <br />the new permit application and their facts have been distorted by their emotions and have nothing <br />to do with the facts or rules and regulations. There is only two miners that have ever read Pr -06 <br />or read these permit applications and those miners have never written a letter because they <br />understand what we are expecting and what has actually happened. <br />The farmers here have leased or sold their lands which has provided for the miners to even have <br />a job. There wouldn't be a coal mine here if it weren't for us farmers. The landowners are <br />guaranteed by the Act that they will be protected and that all rules and regulations governing <br />surface coal mining will have to be adhered to. This has not happened. Western Fuels has <br />finnished the State with untrue statements, fabricated documents, and misleading information <br />that has caused the State to approve permits that should have never been approved causing <br />irreparable damages to some fanners. <br />The Colorado-Regulatory Program-was signed into law in 1977. These laws were suppose to <br />keep the things that are happening today from ever happening. With the false information that <br />was provided to the State, damages were caused. Now, 1 have never cut a miner nor have lever <br />told them how to their jobs or what is best for them. But, Judy, a miner, seems to be an expert on <br />farming. So, I'll set some facts straight. <br />First offJudy, Mr. And Mrs. Morgan also had the old Peabody place which was in alfalfa and <br />pastures and was beautiful. Now , because of ruining, is nothing but dirt and rocks, very ugly. <br />They have owned this place for 59 years and it has been historically irrigated and cropped in that <br />time, and even before that. The house that they are living in was moved here from the Peabody <br />place. They have the same van that they have been driving since 1994. They have the same <br />clothes and - shoes-that they had since that time. They do not drink or smoke as none of us -do, <br />unlike you, and do not waste their money. The equipment belongs to me which 1 purchased at <br />auctions and is the same equipment that I have had since 1991, all very old even then. <br />The money that is paid as royalties is for a product and this product is then resold and they get 3 <br />tunes their money back. Also the royalties have IRS to also deal with, so the money over a 10 <br />year period does not even come close to your wages. The royalty, money is for the coal and the <br />coal alone, not our topsoil, not anything else. In the so- called 20 years which really is 19 that you <br />have worked here, not ONE piece of property has gotten bond release and not ONE piece of <br />property has been returned to the landowners. We have been out of production for almost 10 <br />years now. We were promised faithfully that we would be able to follow right behind the mine <br />C. io -oBq <br />
