2. Future revisions to Mid - Continent's permit submitted in response to <br />the Division's mid -term review or otherwise submitted by Mid- Continent as <br />required by the Division may result in an increase in the estimated cost of <br />reclamation such that additional bond would be required. Any such increases <br />in the reclamation bond shall be submitted by January 15, 1992. <br />C. Permit Transfer <br />1. The parties have entered into this agreement, in part, in order to <br />encourage the sale of the mine to an operator capable of operating the mine in <br />compliance with all applicable requirements. <br />If an operator purchases the site, or otherwise is clearly committed <br />to permitting, bonding and operating the site, before such time as <br />Mid- Continent is required to perform the reclamation activities set out <br />herein, the parties shall enter into negotiations, in good faith, to amend <br />such provisions as are necessary to facilitate the transfer of the permit and <br />to ensure that the facility is maintained, operated and reclaimed in full <br />compliance with all regulatory requirements. <br />2. The purchaser of the mine property contained in the permit area <br />covered by permit C -81 -017 (the successor) shall apply in timely fashion, and <br />such application will be reviewed, pursuant to the provisions of the Colorado <br />Surface Coal Mining Reclamation Act and the applicable regulations, for <br />transfer of the permit. <br />D. Reclamation /Stabilization <br />1. No later than July 12, 1991, permittee representatives will accompany <br />Division and U.S. Forest Service (USFS) personnel on a detailed segment by <br />segment inspection of all portal bench areas as well as associated haul and <br />access roads and all other roads within the permit area. The purpose of the <br />inspection will be to identify road or mine bench areas which may be <br />contributing excessive sediments to receiving streams, to identify acceptable <br />options for interim stabilization, and to identify modifications to the <br />approved reclamation plan which may be warranted with regard to <br />decommissioning or reclaiming roads to meet final land use objectives. <br />2. By September 19, 1991, for good cause shown, the Division will <br />provide Mid - Continent or the successor permittee with a detailed summary <br />containing joint recommendations of the Division and the USFS specifying <br />remedial actions to be taken by the permittee and the timetable for their <br />completion. <br />3. Within sixty days of receipt of the Division /USFS inspection summary, <br />the permittee shall submit an appropriate revision application to the Division <br />addressing modifications to the current plan for interim stabilization and <br />final reclamation of roads and portal areas, incorporating the recommendations <br />contained in the inspection summary. <br />
