Ten-Day Notice. The Division responded to the Ten-Day Notice by <br /> issuing to Resources Notice of Violation C-93-130 (Appendix 9) . <br /> The violation requires Resources to undertake specific action to <br /> ensure that erosion is minimized, using the best technology <br /> currently available to protect the hydrologic balance, topsoil <br /> and vegetation. By correspondence dated October 5, 1993, the AFO <br /> found that the State had appropriately responded to the citizen <br /> complaint by issuing the Notice of Violation. <br /> The Division of Minerals and Geology contends that it has <br /> appropriately implemented the approved program on two levels in <br /> regard to sedimentation from the mine bench outslopes. The <br /> Division has required Resources to modify the approved <br /> reclamation plan so that revegetation of the outslopes is <br /> included as a component of the final reclamation in compliance <br /> with the Colorado Rules. The Division has issued Resources a <br /> Notice of Violation compelling them to take the necessary steps <br /> to ensure that erosion from the outslopes is minimized during the <br /> interim period until final reclamation is complete. The record <br /> indicates that Colorado has appropriately implemented the <br /> approved program. <br /> Water Contaminants in Portal Discharges (Salinity, Toxins in <br /> Crystal River) ; Off-Site Damage to Crystal River; Contamination <br /> of the Crystal River <br /> The Crystal Valley Environmental Protection Association raises a <br /> number of concerns regarding the impacts of the Coal Basin Mines <br /> to the Crystal River. The concerns which have been raised <br /> include non-specific allegations of contaminants flowing from the <br /> mine portals; salinity in the mine water based on OSM data; <br /> allegations of toxins in the Crystal originating from the mine; <br /> and alleged offsite damage to the Crystal extending for miles. <br /> In order to evaluate these concerns, the Division has undertaken <br /> two reviews of available hydrologic data. One review focused on <br /> the serious allegation that unspecified toxins possibly flowing <br /> from the mine site have contaminated the Crystal River, and have <br /> thus impacted the macroinvertebrate populations of the river. <br /> Because the Division does not have access to macroinvertebrate <br /> specialists, the review of the joint U. S. Forest Service/ <br /> Division of Wildlife study was contracted out to an independent <br /> consultant. <br /> The second review, which was conducted by a water chemistry <br /> specialist within the Division, focused on water quality data <br /> collected from the site. The data which was reviewed included <br /> data collected by the Division, and data collected by the OSM. <br /> -6- <br />
