which were written in response to Ten-Day Notices, addressed road <br /> drainage and maintenance, road inslope stabilization, culvert <br /> drainage and outfall maintenance and road reclamation issues. <br /> The Colorado Mined Land Reclamation Board Rules for Coal Mining <br /> (Colorado Rules) establish a standard for sedimentation from <br /> roads. Rule 4.03 states that runoff from roads must not <br /> contribute additional suspended solids to stream flow. The <br /> Division has determined in the past that this standard was not <br /> being met by the operator. As a result, the Division issued the <br /> to Mid-Continent a number of violations relative to the road <br /> sedimentation and erosion issues. <br /> The Division and the OSM have accepted a reclamation plan which <br /> describes reclamation of the Coal Basin road system. The <br /> Division and OSM have identified on-going sediment generation <br /> concerns associated with the roads. As a result, the Division <br /> has issued a number of violations to Resources, some of which <br /> were included in the 1990 Pattern of Violations finding. <br /> Therefore, the Division has implemented the approved program as <br /> required. <br /> sediment From Mine Bench Outslopes <br /> The Division undertook a review of the approved permit in 1992 . <br /> During this review, it was established that no revegetation <br /> requirements had been imposed for the mine bench outslopes. Due <br /> to this problem, the Division initiated discussions with Mid- <br /> Continent Resources in an effort to modify permit requirements as <br /> necessary. As a result of these discussions, Resources submitted <br /> a permit amendment which, among other things, committed to a <br /> revegetation program for these outslopes. This amendment was <br /> properly noticed for public review and comment. Resources has <br /> committed to undertake revegetation coupled with the addition of <br /> soil amendments in an effort to establish vegetation on these <br /> outslopes. Due to the fact that these outslopes were created <br /> long before the implementation of SMCRA, there was no topsoil <br /> salvaged for use on these slopes. Therefore, the Division did <br /> not establish a specific revegetation density or cover <br /> requirement for these areas. However, there is an appropriate <br /> measure of success to be applied to these areas. Rule 4. 15. 10 of <br /> the Colorado Rules, state that previously disturbed areas will be <br /> revegetated sufficiently to control erosion. The outslopes <br /> appropriately fall under the umbrella of Rule 4. 15, and this <br /> standard for success will be employed at these areas. <br /> The Office of Surface Mining received a citizens complaint <br /> alleging that the mine bench outslopes were contributing sediment <br /> to adjacent streams. As a result, the AFO issued the Division a <br /> -5- <br />
