-2- <br /> Proposed Decision <br /> Coal Basin Mines <br /> The Colorado Mined Land Reclamation Division proposes to approve, with <br /> stipulations, an application for a revision to a permit to conduct coal mining <br /> submitted by the Mid-Continent Resources, for the Coal Basin Mines. <br /> This approval decision is based on a finding that the proposed operation will <br /> comply with all requirements of the Colorado Surface Coal Mining Reclamation <br /> Act, C.R.S. 1973, as amended, 34-33-101 et seq. , and the regulations <br /> promulgated pursuant to the Act. <br /> The permit application and the stipulations will become a binding part of the <br /> permit upon approval . The stipulations for the Coal Basin Mines are as <br /> follows: <br /> Stipulation No. 1 <br /> PRIOR TO REACTIVATION OF MINE NUMBER 4, THE PERMITTEE MUST CONSTRUCT <br /> THE SEDIMENT PONDS, AS DESIGNED, ON THE SOUTHEAST SIDE OF THE MINE <br /> NO. 4 BENCH. <br /> Stipulation No. 12 <br /> THE PERMITTEE IS DIRECTED TO CONSTRUCT A BERM AT LEAST THREE FEET IN <br /> HEIGHT AROUND THE LOWER END OF THE TOPSOIL STOCKPILE PRIOR TO <br /> CONSTRUCTION OF THE PILE. THIS BERM MUST BE PLACED A MINIMUM OF <br /> 15 FEET FROM THE TOE OF THE TOPSOIL STOCKPILE. THE TOPSOIL STOCKPILE <br /> MUST BE IMMEDIATELY SEEDED AND MULCHED UPON COMPLETION OF TOPSOIL <br /> STRIPPING IN THE FIVE-YEAR REFUSE DISPOSAL AREA. <br /> Stipulation No. 3 <br /> THE PERMITTEE MUST MONITOR WATER QUANTITY AND QUALITY IN DISNEY CREEK <br /> AND SUTEY CREEK ABOVE THEIR RESPECTIVE CONFLUENCES WITH COAL CREEK. <br /> WATER QUANTITY MONITORING MUST BE SUFFICIENT TO DIFFERENTIATE SEASONAL <br /> FLUCTUATIONS. WATER QUALITY MONITORING MUST BE DONE ON A QUARTERLY <br /> BASIS WITH ANALYSIS FOR THE SAME PARAMETERS AS REQUIRED FOR BEAR CREEK, <br /> DUTCH CREEK AND COAL CREEK. <br /> Stipulation No. 4 <br /> BY FEBRUARY 1, 1985, THE PERMITTEE SHALL SUBMIT A PLAN FOR SEALING THE <br /> ROCK TUNNEL ADITS. THIS PLAN SHALL CONTAIN, AT A MINIMUM, <br /> SPECIFICATIONS FOR SEALING THE PORTIONS OF THE ROCK TUNNEL THAT CROSS <br /> THE COZZETTE, ROLLINS, AND MIDDLE SANDSTONES TO PREVENT FUTURE MIXING <br /> OF WATERS IN THESE AQUIFERS AND SHALL INCLUDE SPECIFICATIONS FOR <br /> SEALING THE ADITS TO PREVENT GROUND WATER FROM FLOWING FROM THE ROCK <br /> TUNNEL ONTO THE SURFACE. <br /> THE PERMITTEE MUST OBTAIN DIVISION APPROVAL OF THE PLAY BY MAY 1 , 1985. <br />
