See attached DRMS Availability of Records. BACKFILL and GRADING — Rule 4.14 Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: The completed backfilling and grading operations at the Fish Creek Tipple site were inspected. The site remains stable with no evidence of erosion or instability observed. All erosion control ditches were in place with no damage noted. HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10, Diversions 4.05.4, Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: Ponds B, C, D, E, F, G, 6NM, 18LT, 6NM sediment pond, the Fish Creek borehole ponds, the Fish Creek Tipple pond and the Pit Pond were observed during the inspection. Discharge was noted at Pond D. All other ponds were not discharging. All pond embankments were well vegetated and stable with no problems noted with the exception of the following: - The sediment sump located on the northwest corner of pond B was receiving heavy run -off from the trick load out access road. In order to alleviate the amount of water entering the sump, TC has breached an area on the north end of pond B. Runoff water is entering pond B at the breached inlet. No discharge was noted at pond B at the time of the inspection. This repair work will need to be addressed and cleaned up to provide additional protection from erosion.. If design changes to pond B are implemented or additional culverts installed, a revision to the Division is required to be approved before work begins. In addition, the inlet to the sediment sump displays heavy erosion; this area should be cleaned up and stabilized as the erosion is cutting into the Pond B access road.
