Thus, an <br /> SPCC plan will be required as discussed on page <br /> 10 of the permit. <br /> The permittee has not submitted the one time <br /> analysis requested in the permit renewal applica- <br /> tion. However, the permittee has indicated that <br /> this information will be submitted once a discharge <br /> has occurred. The parameters to be analyzed are <br /> shown on page 6 of the permit. As discussed on <br /> page 7, all mine water discharges must be <br /> sampled. In this case, a total of 4 discharges <br /> should be sampled. One from each of 002 thru <br /> 005, the mine dewatering points. <br /> This permit may be re-opened and modified as <br /> discussed on pages 15 and 16 if there is a <br /> significant change in operations at the facility, <br /> or if there is a significant change in state or <br /> federal water quality standards or technology <br /> based effluent limitations. <br /> Donald H. Simpson <br /> March 10, 1982 <br /> Pursuant to Section 122.62 (c) (2) of the May <br /> 19, 1980 Consolidated Permit Regulations, any <br /> permit' issued after June 30, 1981 must contain <br /> BAT effluent limitations. On May 18, 1982, <br /> the Division lost regulatory authority to <br /> utilize Best Engineering Judgement for establish- <br /> ment of technology based effluent limitations on <br /> a case-by-case basis. Such action was the <br /> result of a determination by the Legislative <br /> Joint Committee on Legal Services. Loss of this <br /> authority prevents total compliance with federal <br /> regulation and thus EPA may veto this permit <br /> and issue a federal permit, consistent with <br /> provisions of Section 122.62 (_c) (2) . <br />
