BLATTNER <br />ENERG <br />be given to the Agricultural Agency or, when the copy is unavailable, the Agricultural Agency shall be <br />permitted to read the label on the container. <br />• Pesticides for weed control shall be applied with a photosensitive dye which will produce a <br />contrasting color when sprayed upon the ground. The color shall disappear between 2 and 3 days <br />after being applied. The dye shall not stain any surfaces nor injure plant or animal life, when applied <br />at the manufacturer's recommended application rate. <br />• Pesticides shall not be applied when weather conditions, including wind conditions, are unsuitable <br />for application work. <br />• Any new or existing plants and soil which, in the opinion of the Agricultural Agency, have been <br />damaged by the application of pesticides shall be replaced by the Contractor at the Contractor's <br />expense. <br />• The Contractor shall comply with all rules and regulations of the Department of Food and <br />Agriculture, the Department of Health, the Department of Industrial Relations, and all other <br />agencies which govern the use of pesticides required in the performance of the work on the <br />contract. <br />Pesticides shall include but shall not be limited to herbicides, insecticides, fungicides, rodenticides, <br />germicides, nematocides, bactericides, inhibitors, fumigants, defoliants, desiccants, soil sterilants and <br />repellents. <br />Any substance or mixture of substances intended for preventing, repelling, mitigating, or destroying <br />weeds, insects, diseases, rodents, or nematodes and any substance or mixture of substances intended <br />for use as a plant regulator, defoliant or desiccant shall be considered a pesticide. <br />Monitoring Plan <br />During Mining Activities <br />Constant monitoring for the presence of invasive weeds will be ongoing throughout the mining phase <br />within the proposed mine. Reference materials will be provided to workers that will aid them in <br />identifying weed species. If any of these weeds are identified within the site, the front line supervisor <br />will be notified. If identified, the local NRCS office will be consulted to find the appropriate method to <br />eliminate the presence of the identified weed. <br />After Mining Activities <br />To ensure there is not an outbreak of invasive weeds after mining activities are completed, a third party <br />will be hired to monitor the site monthly until sufficient revegetation has been achieved. After <br />revegetation has been established, the third party representative will visit the site semi - annually for two <br />years to ensure no invasive weeds have become present within the site. If any of these weeds are <br />identified, the local NRCS office will again be contacted to develop the best method and approach to <br />dispose of the weed growth. <br />
