Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />SWSP ID 2709 RECEIVE - <br />Plan Period: April 1, 2012 — March 31, 2013 4AY 2 12 012 <br />Dear Ms. Aldred: Division of Reclamation. <br />Mining & Safetv <br />We have reviewed your December 31, 2011 and letter requesting renewal of the substitute <br />water supply plan for 2011, in accordance with Senate Bill 89 -120 for a sand and gravel pit (well <br />permit no. 54064 -F, ID 1406561) owned by Stonewall Springs Quarry, LLC /Morley Companies and <br />operated by Fremont Paving & RediMix, Inc. (Fremont Paving). The required renewal fee of $257.00 <br />for the 2012 plan year has been accepted under receipt no. 3653454. The applicants shall be <br />responsible for compliance with this plan, but the State Engineer's Office may also pursue the <br />landowner for eventual compliance. <br />PLAN OPERATION <br />This pit did not exist, and no ground water was exposed, prior to January 1, 1981. This plan <br />proposes to replace depletions to the Arkansas River that result from mining aggregate. There will <br />not be a concrete batch plant. Previous approvals prior to 2009 were for dry mining, with the only <br />water exposure consisting of dewatering trenches (0.3 acre), a collection area (0.1 acre), and a <br />return trench (0.1 acre). <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of <br />Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must <br />comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and <br />Regulations for the protection of water resources. The April 30, 2010 letter from DRMS <br />requires that you provide information to DRMS to demonstrate you can replace long term <br />injurious stream depletions that result from mining related exposure of ground water. The <br />DRMS letter identifies four approaches to satisfy this requirement.
