April 2012 Page 1 -2 <br />1.2 Professional Engineers Review [40 CFR 112.3(d)] <br />The undersigned Registered Professional Engineer is familiar with the requirements of Title 40 <br />of the Code of Federal Regulations [40 CFR 112] and has supervised the examination of the <br />facility. Registration Number <br />1.3 Location of SPCC Plan [40 CFR 112.3(e)] <br />A complete copy of this SPCC will maintained in accordance with [40 CFR 112.3(e)] at the <br />NECC main office and shall be available for viewing whenever the facility is open during <br />normal business hours. <br />1.4 Plan Review [40 CFR 112.3 and 112.5] <br />1.4.1 Scheduled Plan Reviews <br />The most recent revision of the SPCC for the New Elk Mine was completed in 1995 while the <br />mine was in reclamation. Since that time, the decision was made to restart the mine and, in <br />accordance with [40 CFR 112.5(b)], NECC must review the current SPCC Plan and update it to <br />current standards.
