Photos were <br />taken on Thursday, May 3, 2012 by Harry Ranney, and were later evaluated by Marcia Talvitie <br />of the Division's Durango Field Office. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />• The water truck could be seen spraying the haul road at King II (Photo 1). <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement, Drainage Control; Surface Stabilization: <br />• Loads of Coal Mine Waste appear to have been recently dumped on the top surface of the <br />permitted disposal area at the King I site (Photo 2). <br />• In Photo 3, the extent of Coal Mine Waste placed as backfill on the King I highwall and <br />tipple bench can be seen. This activity resulted in the Division's issuance of CV 2012- <br />003 in April, 2012. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures <br />4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; <br />Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments <br />4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />• At King I, the West Sedimentation Pond appears to have dried up completely; the East <br />Pond continues to hold some water (Photo 4) <br />• The King II pond appears to be completely dry (Photo 1). <br />• Clean water diversion ditches are identified in Photos 1, 2, 5 and 6. <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 3 Page 2 of 8 <br />
