2. Oxbow predicts there is adequate volume available in the II West Coal Refuse for <br />the mining of the current operation as well as the East Elk Creek Lease. We do not anticipate an <br />unusual amount of refuse to be generated from the area. In terms of elevation, the overall refuse <br />facility design height from the design toe (6050') to the design crest (6,250') is 200'. The latest <br />survey for the facility indicated the elevation of the refuse was at the approximate 6,119' <br />elevation. Oxbow has filled the bottom 69' of the design volume and has 131' of design volume <br />remaining. With the "V" shape of the valley in which the refuse is contained, these remaining <br />upper areas will contain proportionately more refuse. <br />3.
