Item 2. Right of Entry <br />Please find the right of entry for the lease modification Tract #5 attached for inclusion into the <br />PAP. <br />Item 3. Fish and Wildlife Resources Information <br />The Division has asked for an update regarding three new Colorado species designated for <br />Federal Protection as threatened or endangered. Recall that Monarch and Associates provided the <br />Wildlife and Vegetation block clearance reports for Oxbow. <br />We have queried John Monarch, of Monarch and Associates regarding the species and he has <br />provided the following comments: <br />• Page 2 <br />"Jim <br />In reviewing the data from the August 2005 and other studies I have <br />conducted in the area these species were never observed. This was not <br />unexpected as none of these species are known to occur in the area. <br />All of these species have very limited distribution. Suitable growing <br />conditions for any of these species is lacking in the proposed permit <br />revision area. Following is a brief writeup on each. <br />The Pagosa skyrocket in only found in a couple of locations within a <br />few miles of Pagosa Springs and is endemic to Archuleta County. They <br />are found on disturbed fine textured soils derived from the Mancos <br />Formation. <br />The Parachute beardtounge is endemic to Garfield County. It is found <br />on sparsely vegetated, south facing, steep, white shale talus of the <br />Parachute Creek member of the Green River Formation at elevations <br />of 8000 - 9000 feet. <br />DeBeque phacelia is endemic to Garfield and Mesa Counties. They <br />are found on sparsely vegetated, steep slopes; in chocolate -brown or <br />gray clay; on Atwell Gulch and Shire Members of the Wasatch <br />Formation at elevations of 4700 -6200 feet. <br />Please call me if you have any additional questions. <br />John" <br />In summary, John Monarch has indicated the three species will not be impacted <br />by the proposed mining expansion principally because of the lack of broken <br />shale, clay shale, shale outcrop type habitats necessary for these species. <br />Item 4, Operation Plan <br />1. PAP page 2.05 -7 will be modified to include a discussion of the mining of the east <br />panels for COC- 70615. As we propose to withdraw the LBA from PR -06, we will address this <br />issue in the later PR -07 submittal specific for the lease. <br />
