PERMIT #: M- 2004 -030 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: April 25, 2012 <br />deck which contains a stone cutter, pallets of stone, and a fuel tank. The Division observed that the berm <br />around the fuel tank was not of sufficient size to function as a secondary containment in the event the fuel <br />tank ruptured. This has been cited as a problem and will require corrective action by the Operator; please see <br />the first page of this report for additional information. In addition, the Operator is storing 55 gal. drums of <br />motor oil which have been set on top of pallets; no leaks or spills were observed. <br />2) TBS2 - This quarry is located in the northwest corner of the site. The Operator has mined to the edge of the <br />north and west permit boundaries and is primarily mining downward. The Division observed a highwall along <br />the western boundary that was approximately 200 ft. in length and 15 - 30 ft. in height. Overburden has been <br />stockpiled around the perimeter of the site for use during final reclamation. The east end of TBS2 has been <br />leveled off into a parking /storage area. <br />3) Processing Area - This area is located to the southeast of TBS1. The Division observed stockpiles of stone on <br />pallets, several trucks and a sandstone overburden stockpile. <br />Off -site Damage: <br />During the inspection, the Division observed that the affected area associated with the Processing Area was <br />not delineated by monuments or other markers. The Operator stated that he informed the Division in the <br />2008 Annual Report that he was going to eliminate the one acre Processing Area and increase TBS2 by one <br />acre. The Division confirmed the Operator provided this information in the 2008 Annual Report. However, it <br />was explained to the Operator that the Division does not allow the transfer of unaffected acreage from one <br />part of the mine site to another. In order to increase the affected area in TBS2, the Operator must submit an <br />Amendment Application. As noted in this report, the Division found that the Processing Area contained pallets <br />of flag stone as well as a stockpile of sandstone rubble. <br />The Division traversed the three separate permitted areas which comprise the T Bone Stone Quarry with a <br />Trimble GeoXT GPS unit in order to determine the extent of disturbance at the site and to document the <br />location of the boundary markers. The data were downloaded into GPS Pathfinder Office and the total <br />disturbance associated with the operation was determined to be 10.61 acres or 0.71 acres beyond what the <br />operation is permitted for. Please see the attached map showing the location of the disturbance relative to <br />the location of the boundary markers. The disturbance associated with each of the permitted areas is as <br />follows: <br />1) TBS1 = 6.28 <br />2) TBS2 = 3.7 <br />3) Processing Area = 0.63* <br />*During the inspection the Division only traversed the area being used to store stone on pallets. The <br />sandstone rubble pile was not traversed as the Operator indicated that this disturbance was present prior to <br />the issuance of the Reclamation Permit. The Division reviewed aerial photographs from before and after the <br />permit was issued and determined that the disturbance occurred subsequent to the issuance of the permit <br />(see attached aerial photographs). The extent of the disturbance associated with the sandstone pile was <br />calculated using a 2011 aerial photograph in conjunction with ArcMap GIS software. <br />Based on the findings of this inspection, the Division has reason to believe the Operator is in violation of C.R.S. <br />34- 32.5- 116(4)(i) for failure to protect areas outside of the affected land from slides or other damage <br />Page 3 of 6 <br />
