April 11, 2012 C- 1996 -083 /13owie No. 2 Mine BFB <br />PROCESSING WASTE /COAL MINE WASTE PILES — Rule 4.10 and 4.11 <br />Stabilization; Placement: <br />Drainage Control; Surface <br />Gob pile 42 was being graded and compacted. Progress was being made on compacting coal mine waste <br />that was stacked for drying over winter. <br />The wet refuse material from the processing plant is currently stored in large piles on the south side bench of Gob <br />Pile #4 to allow the material to dry. The refuse material was piled too close to the edge of the outslope and has <br />flowed down the refuse pile outslope. Lateral ditches D -D8 and D -F 1 on the outslope of gob pile #4 were blocked <br />from unstable gob flowing downhill (photo 4). The western collection ditch D -D3 was blocked with unstable gob <br />that flowed into the ditch (photo 5). The permit states that, "the top of the pile will be sloped to the east and west <br />to ensure run -off from the fill surface flows to the collection ditches and is not allowed to flow over the outslope <br />of the fill. A berm will be maintained to assure water does not flow over the outslope." During this inspection, <br />refuse material had flowed over the outslope and there was rill /gully evidence of run -off flowing off the top <br />surface and over the outslope (photo 6). NOV -CV- 2012 -OOX is being issued for failure to assure water does not <br />flow over the outslope. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />The coal mine waste haul road was dry, well maintained, passable and roadside ditches were in place. The <br />main access haul road was in good condition and well maintained. The access road to the upper utility bench was <br />in good condition. <br />REVEGETATION — Rule 4.15 Vegetative Cover; Timing: <br />The results from the cheatgrass burn treatment appear to have been successful for the present growing <br />season. Cheatgrass is a persistent species and repeated treatments will continue to be necessary for the eradication <br />of cheatgrass from the topsoil stockpiles. <br />In the same areas as the cheatgrass burn treatment, jointed goatgrass (Aegilops cylindrica) has become the <br />dominant species. Jointed goatgrass is Colorado List B weed and needs to be managed to stop its continued <br />spread. It is suggested that the Delta County Noxious Weed Coordinator, Webb Callicutt, be consulted to develop <br />a plan to control /eradicate jointed goatgrass from the topsoil and coverfill stockpiles. Also, seed mix No. I (Pen <br />Section 2.05.4(2)(e), page 2.05 -69) should be re- applied for soil stabilization and additional weed control. <br />Patches of whitetop were found on the gob 43 topsoil stockpile.
