Christine Belka, Spencer Shumate and Daniel MacKinnon from the <br />Office of Surface Mining (OSM) conducted a partial oversight inspection in conjunction with a special focus <br />evaluation. The special focus evaluation assessed the DRMS's Prevention of Off -Site Impacts on Bond Forfeiture <br />Sites. Weather conditions were sunny and warm and ground conditions were dry at the site. The inspection began <br />at the remaining sediment pond located at the lower elevation of the reclaimed mine site and proceeded up the <br />reclaimed access road to the 91 Mine Bench and then up and above the backfilled portal. From there the <br />inspection continued to the upper drainage and then down the steep riprap permanent drainage to the reclaimed <br />lower facilities area. <br />SITE BACKGROUND <br />American Shield performed reclamation on the site in 1990 and was granted Phase I bond release. In June 1991, <br />the OSM objected to the DRMS's approval of highwall retention in the Fruita Mine reclamation plan. In <br />September 1991, the DRMS issued a notice of violation for failure to reclaim to approximate original contour and <br />failure to eliminate the highwall. In December, 1993 a failure to abate cessation order was issued for failure to <br />abate the 1991 notice of violation. The mine permit was revoked and the bond forfeited in 1994. <br />The Fruita Mine has had no operator or permitteee since the bond was forfeited. DRMS contractors conducted <br />initial bond forfeiture maintenance work in 1996 and additional remedial work in 2000. Final reclamation was <br />completed in 2009 and included sediment pond maintenance, installing rock check dams along the access road, on <br />the portal bench, and the outslope of the fill, drainage repair and construction, portal repair, construction of a rock <br />apron around the portal area, and reseeding of all areas disturbed through this activity.
