(1) Tree planting; <br /> (m) Mine 4 revegetation; <br /> (n) Warehouse vacinity; <br /> Response: The"Statement of Funds Received And Paid: Coal Basin Mine <br /> Reclamation Account", dated January 21, 1998, contains a complete accounting of funds <br /> expended by Minerals and Geology at Coal Basin to that date. This document was provided <br /> to Mid-Continent Resources and its attorneys on January 22, 1998. All expenditures since <br /> January 21, 1998 are tabulated in response to Interrogatory 16, above. <br /> Please note that the Division's documents will show a credit of$6,707.84 to the Mid- <br /> Continent account. This credit does not represent additional money being entered into the <br /> account, but rather corrects erroneous entries of this total amount into unrelated accounts. <br /> Therefore, the current balance of the Mid-Continent account is $244,061.29 (January 21, <br /> 1998 balance minus 1998 expenses plus credit amount). <br /> INTERROGATORY NO. 20: Identify all documents concerning all expenditures <br /> described in Interrogatory No. 19 above. <br /> Response: All documents concerning the expenditures described in interrogatory <br /> 19 are contained in respective files for each project. The files for these projects are extensive <br /> and are kept in the normal course of the Division's business. These files will be made <br /> available for inspection upon reasonable advance notice at a time and date mutually <br /> convenient to the parties at the Division's office in Grand Junction. <br /> INTERROGATORY NO. 21: Itemize by amount and date all expenditures for native <br /> seed collection for Coal Basin reclamation in 1998. <br /> Response: Due to the current litigation, native seed collection was not undertaken <br /> in 1998. <br /> INTERROGATORY NO. 22: Describe all reclamation work to be done by any person <br /> or entity in Coal Basin in 1999 irrespective of property ownership or funding source. <br /> Response: The Bear Creek Project, located on a pre-law portion of the Old Refuse <br /> Pile, and mine maintenance, if necessary, will be accomplished in 1999. Due to the on-going <br /> litigation, no other reclamation activity at Coal Basin is contemplated in 1999. <br /> INTERROGATORY NO. 23: Set forth all facts and identify all documents supporting <br /> the affirmative defense in your Answer to Amended Third-Party Complaint that Third-Party <br /> Plaintiffs have failed to exhaust administrative remedies. <br /> 9 <br />
