Please note <br /> that this memo will not be produced on the basis that it falls within the deliberative process <br /> and attorney work product privileges. <br /> INTERROGATORY NO. 11: Identify all hydrologic control plans for reclamation for <br /> Mines 1, 2, 3, and 4. <br /> Response: Hydrologic control plans are contained in the following documents: <br /> Coal Basin Mine Permit Application, Coal Basin Mine Permit Renewal Application; <br /> Findings of Compliance documents dated April, 1983, August, 1984, February, 1986, July, <br /> 1992; <br /> Correspondence dated July 24, 1995 from Lou LaGiglia, Trustee, to Michael Long, Division <br /> Director, regarding DMG bid packages and bids received; <br /> Correspondence dated April, 1994 from Greg Lewicki to Steven Renner regarding mine <br /> bench reclamation; <br /> The files for the following projects contain information pertinent to hydrologic control at each <br /> Project Area: Coal Basin/Mine 3 (PKA-5-359); Coal Basin/Mine 4 (PKA-5-360); Coal <br /> Basin/Mine 1 & 2 (PKA-6-364). <br /> These identified files and the documents are voluminous and are kept in the normal course of <br /> the Division's business. The files and documents will be made available upon reasonable <br /> advanced notice for inspection at a time and date mutually convenient to the parties at the <br /> Division's office in Grand Junction. The Findings of Compliance documents have been <br /> produced pursuant to Mid-Continent's 1998 document production request. <br /> 5 <br />
