ATTACILMENT <br /> SUMMARY OF DOCUMENTS SUPPORTING CLAIM <br /> This is a summary of the voluminous documents supporting <br /> the proof of claim filed by the Division cf Minerals and Geolcgy <br /> ("DMG") of the the Colorado Department of Natural Resources <br /> against Mid-Continent Resources, Inc. ("MCR") , Case No. 92 11658 <br /> PAC, Chapter 11. <br /> MCR is obligated to reclaim its coal mine located in Pitkin <br /> and Gunnison counties pursuant to the provisions of Mining pe=a-t <br /> number C-81-017. The obligations are specified in the permit, <br /> several amendments and revisions to the permit, the permit appli- <br /> cation and several applications for permit revisions and amend- <br /> ments. MCR's reclamation obligations are further defined in ad- <br /> ministrative orders issued by the Mined Land Reclamation Board <br /> ("MLRB") in May 1991 and May 1992, and the provisions of the Col- <br /> orado Surface Coal Mining Reclamation Act, and the regulations <br /> promulgated thereunder. In addition, MCR is required to coMply <br /> with all notices of violation and cessation orders issued by Dr:G, <br /> including but not limited to NOV nos. C-93-086, C-93-0891 <br /> C-93-090, C-93-091, C-93-0921 C-93-093, C-93-094, C-93-0951 <br /> C-93-096, C-93-097, C-093-098, C-93-099, C-93-0106, C-93-107, <br /> C-93-108 and C-93-109 . The cost of corµpliance with all such <br /> requirements has not been liquidated. <br /> MCR's obligation to reclaim the coal mine is secured by a <br /> deed of trust, dated December 11, 1984, on certain property in <br /> Garfield County, which deed of trust, in the amount of <br /> $31000, 000, was recorded on the same date, bearing Reception No. <br /> 357928 and appearing in Book 661, Pages 215-217, Garfield Coun;.v <br /> Clerk and Recorder's Office. Such deed of trust was amended by <br /> Addendum to Deed of Trust dated August 29, 1988 and recorded on <br /> October 17, 1988 bearing Reception No. 396106 and appearing in <br /> Book 742 , Pages 725 and 726, Garfield County Clerk and Recorder's <br /> Office. The deed of trust, as amended, is subject to "Coal <br /> Reclamation Bond For Use With Deed of Trust - Realty Federal <br /> Mine" entered into between MCR and DMG and dated August 28 , 1968 . <br /> MCR is also obligated to reclaim its Limestone quarry, <br /> knou-n as the Mid-Continent Limestone Quarry, located in Garfield <br /> County pursuant to reclamation permit M-82-121. The reclamation <br /> obligations are specified in the permit, the permit application; <br /> any permit amendments and revisions, and the applications there- <br /> for; the provisions of the Colorado Mined Land Reciarlation Act, <br /> and the regulations promulgated thereunder. in addition, IICR is <br /> required to comply with any and all Notices of Violation and <br /> Cease and Desist Orders issued by the MLRB.
