3) Failure to Follow Plan -One of DMG's first reclamation projects was the final reclamation of the <br /> Sutey Refuse Area.Although MCR had recently submitted a revision to modify the permanent system <br /> of ditches and recieved approval (TR-25) we noticed that it was completely ignored in DMG's bids <br /> for the work. When we questioned this, it was found out that the DMG project manager was <br /> "unaware"of the revision,as pointed out in Renner's letter to Mike Long of 10/19/94. Also,the ditch <br /> designs in the DMG were never based on prudent hydrologic engineering as were the designs in TR- <br /> 25. The plans for DMG's ditch system at Sutey would never have been approved by the DMG's own <br /> hydrology- professionals. <br /> 4) Implementation and Failure of Experimental Reclamation - In the Mine# 4 revegetation project, <br /> DMG undertook measures which were neither contemplated nor approved in the reclamation plan, <br /> or well advised in the situation. DMG undertook the modification of outslopes through mechanical <br /> means (imprinter machine) to facilitate revegetation. By their own documentation, DMG admitted <br /> this measure was a failure. DMG also employed the application of a surface coating (BFM) to the <br /> steep outslope at Mine # 4, which was washed away during the subsequent winter. These failed <br /> measures were subsequently proposed in the 1998 project bid for north basin steep slope <br /> revegetation. The cost of failed revegetation measures at Mine # 4 was $72,260.00, yet DMG <br /> proposed to employ them again. <br /> 5) Likely Failure on Latest Steep Slope Reclamation Method -the DMG North Basin bid states that <br /> laborers will be lowered down the slopes (up to 900 feet down) by ropes in order to create small <br /> benches (4" x 10' x 4") with an approximate spacing of 2.0 feet. In order to create benches on an <br /> already extremely steep slope(1:1), the cut and fill portions of the bench will be extremely unstable <br /> and will likely wash out within 2 years due to massive snow and some rainfall events. See Exhibit <br /> 3. This will create a large surge of sediment to the areas downstream: exactly what the DMG should <br /> be trying to prevent.... and they plan to spend a lot of money doing it. <br /> 5 <br />
