Attachment to Permit Renewal Application Permit# CO-0000396 <br /> Page 2 <br /> the exception of reclamation at the Mine #5 portal area, which was performed by Mid- <br /> Continent, reclamation plans and decisions have been made without consultation with <br /> Mid-Continent. Fee lands owned by Mid-Continent have passed into ownership of the <br /> U.S. Forest Service. Mid-Continent does not believe that Mid-Continent has authority <br /> to enter these previously mined areas in such a way as to disturb the reclamation, <br /> including drainage and sediment control measures carried out by the DMG, or to affect <br /> the land surface now owned by the U.S.F.S. All decisions as to the use and activities <br /> occuring on these areas is within the sole discretion of the U.S. Forest Service. <br /> Decisions as to any remaining reclamation work done at these sites, including removal <br /> of sediment ponds and reclamation of the roads which access the ponds, is within the <br /> discretion of the DMG and the U.S. Forest Service, and is thus beyond the control of <br /> Mid-Continent. <br /> Consequently, Mid-Continent requests permit renewal as to the listed outfalls and <br /> activities remaining on properties under ownership of Mid-Con, L.L. C., and further <br /> requests to be released from responsibility for outfalls previously permitted on those <br /> lands now owned by the U.S. Forest Service, and controlled by the U.S. Forest Service <br /> and the DMG. <br /> 2.
