included for road cut-slopes and 7.4 acres are included for road fill slopes. Many of the
roads slopes surveyed in this report have stabilized and revegetated. Please state wheyher
the acreages in the Geo-Hydro Report are part of the original reclamation plan, whether
they are vegetated, and whether a revegetation efforts on these areas has a reasonable
chance for success. Please state upon what this opinion is based. Are there documents
relating to either this opinion(s)? If so, please attach a copy of such documents to your
responses to these interrogatories or state the circumstances under which these documents
may be inspected and/or copied.
46. As we read the DMG' Reclamation Accounting, it appears DMG
contemplates performing "mine maintenance'. Please states what this includes and why
it is believed to be necessary. Please explain what work has been or is proposed for this
reclamation feature by location, component and cost, where in the approved Reclamation
Plan this work is the responsibility of MCR and where this is covered in the Reclamation
Bond? If this work is not covered by the approved Reclamation Plan, what is the authority
for it? Are there documents relating to either this reclamation feature? If so, please attach
a copy of such documents to your responses to these interrogatories or state the
circumstances under which these documents may be inspected and/or copied.
47. In connection with the foregoing mine bench outslope revegetation,is there
any document to support the success of this revegetation effort? If so,please attach a copy
of the cost documents to your responses to these interrogatories or state the circumstances
under which such documents may be inspected and/or copied.
48. In connection with the seed bid referred to in the DMG Reclamation
Accounting for reseeding and revegetating in Coal Basin,is there a specified mix for what
was bid? Does this bid mix coincide with the mix that was approved in 1994 for the entire
site? Are there documents relating to these costs? If so,please attach a copy of the mix,bid
and cost documents to your responses to,these interrogatories or state the circumstances
under which these documents may be inspected and/or copied.
49. In connection with the foregoing seed bid, is this bid in addition to the
revegetation costs for the mine benches, road surfaces and road cuts/fills? Are there
documents relating to these costs? If so, please attach a copy of such documents to your
responses to these interrogatories or state the circumstances under which these documents
may be inspected and/or copied.
50. If we read the DMG Reclamation Accounting correctly, it appears that all
costs for revegetation(including tree purchase and plant)adds up to$457,000.Yet the costs
per acre to perform this work is significantly higher. Would you please explain this
discrepancy? Are there documents relating to these costs? If so,please attach a copy of such
documents to your responses to these interrogatories or state the circumstances under
INITIAL INTERROGATORIES
CIVIL NO.97 cv 131-3 -15- PROPOLTNDED TO DMG BY MCR
