If so, <br />please attach a copy of such documents to your responses to <br />these interrogatories or state the circumstances under which <br />these documents may be inspected and /or copied. <br />Response: The Division anticipates tree planting to be <br />accomplished at all reclaimed areas except the mine bench <br />outslopes and an approximately twenty foot wide corridor along <br />the haul roads. Planting at a rate of 200 trees per acre, to <br />accommodate assumed mortality rates, is planned. <br />Components and costs are tabulated in the Division's <br />January 23, 1998 submittal titled Estimate Reclamation Costs <br />by Anticipated Project. <br />Objection: As to that portion of the interrogatory <br />which refers to the term Reclamation Plan, please see the <br />Division's general objection to the Defendants' definition of <br />the term reclamation plan. As defined by the Defendants in <br />the interrogatories, "reclamation plan" excludes many portions <br />of the approved permit and, therefore, excludes many <br />reclamation commitments and requirements. The Division's <br />response includes references to reclamation requirement <br />contained in other portions of the approved permit: <br />Volumes 8 Chapter V Table V -E -1, V -E -2: <br />Proposed Decision and Findings of Compliance dated <br />August, 1984, Section XI. <br />As defined in the interrogatories, the term NLRB) <br />Reclamation Bond is defined as the security or pledge posted <br />by Mid - Continent Resources. This document is a Deed of Trust <br />regarding a parcel of land referred to as the Limestone or <br />Rock Dust Plant. This document does not discuss reclamation <br />requirements or costs.
