As to that part of the interrogatory referring to <br />reclamation bond, as defined by the Defendants in these <br />interrogatories, the term {MLRB} Reclamation Bond means the <br />security or pledge posted by Mid - Continent Resources. This <br />document is a Deed of Trust regarding a parcel of land <br />referred to as the Limestone or Rock Dust Plant. This <br />document does not discuss reclamation requirements or costs. <br />As such, "reclamation bond" does not refer to any task or <br />cost. <br />47. In connection with foregoing mine bench outslope <br />revegetation, is there any document to support the success of <br />this revegetation effort? If so, please attach a copy of such <br />documents to your responses to these interrogatories or state <br />the circumstances under which these documents may be inspected <br />and /or copied. <br />Response: There are documents to support the success of <br />revegetation effort. These documents will be made available <br />for inspection at a mutually convenient time at the Division's <br />offices in Denver and \or Grand Junction. <br />48. In connection with the seed bid referred to in the <br />DMG Reclamation Accounting for reseeding and revegetating in <br />Coal Basin, is there a specified mix for what was bid? Does <br />this bid mix coincide with the mix that was approved in 1994 <br />for the entire site? Are there documents relating to these <br />costs? If so, please attach a copy of such documents to your <br />responses to these interrogatories or state the circumstances <br />under which these documents may be inspected and /or copied. <br />Response: Yes, there is a specified seed mixture being <br />used at the site. The only seed mixture which was approved in <br />1994 pertains to the Load Out facility near Carbondale. The <br />Division is using a seed mixture proposed by Mid - Continent <br />Resources in September, 1993. <br />Documents pertaining to this interrogatory will be made <br />available for inspection at a mutually convenient time at the <br />Division's offices in Denver and \or Grand Junction. <br />49. In connection with the foregoing seed bid, is this <br />bid in addition to the revegetation costs for the mine <br />benches, road surfaces and road cuts /fills?
