Please explain what work has been or is proposed <br />for this reclamation feature by location, component and cost, <br />where in the approved Reclamation Plan this work is the <br />responsibility of MCR and where this covered in the <br />Reclamation Bond? If this work is not covered by the approved <br />Reclamation Plan, what is the authority for it? Are there <br />documents relating to either this reclamation feature? If so, <br />please attach a copy of such documents to your responses to <br />these interrogatories or state the circumstances under which <br />these documents may be inspected and /or copied. <br />Response: Mine maintenance includes, but is not limited <br />to rill and gully repair on reclaimed lands; dredging of <br />ponds; clearing debris from pond inlet ditches; re- seeding <br />areas which failed to successfully revegetate (including <br />fertilizer and mulch acquisition and application, and site <br />preparation); excavation of materials from stream channels; <br />maintenance of the Dutch Creek Flume; repair and \or <br />replacement of low water crossings and rolled dips; placement <br />of sediment control devices; reconstruction of failed ditches <br />and channels; and removal of landslide debris in order to <br />maintain access. <br />Performance of these and similar tasks is necessary to <br />ensure that successful reclamation of the site is achieved, <br />while maintaining compliance with applicable regulations. <br />Estimated costs and components are tabulated by <br />anticipated machine times, because it cannot be predicted with <br />certainty where problems will develop. Please refer to the <br />Division's January 23, 1998, Accounting for costs and <br />components of mine maintenance. <br />Objection: As to that portion of the interrogatory <br />referring to the term Reclamation Plan, please see the <br />Division's general objection to the Defendants' definition of <br />reclamation. As defined in the interrogatories, the term <br />reclamation plan excludes many portions of the approved permit <br />and therefore, excludes many reclamation requirements mandated <br />by MCR's permit.
