14. Is all of the work and cost detailed considered to <br />be within the scope of the approved MLRB Reclamation Plan? If <br />not, please detail items outside the scope of the Plan. <br />Response: Objection: Please refer to the Division's <br />general objection to the Defendants' definition of <br />"reclamation plan." This definition excludes many portions of <br />the approved permit and, therefore, excludes many reclamation <br />requirements mandated by MCR's permit. The Division's <br />position is that each of the projects set forth in the <br />Division's Accounting, dated January 23, 1998, are necessary <br />to successfully complete the reclamation plan. <br />15. Has the Forest Service approved the work entitled <br />"Pond Removal "? If so, please provide documents indicating <br />such approval, and /or identify the person(s) granting such <br />approval. <br />Response: No. <br />16. Has the Water Quality Control Division, State of <br />Colorado, approved the proposed "Pond Removal "? If so, please <br />produce all documents showing or indicating any such approval, <br />or identity of the person(s) who granted such approval. <br />Response: No. <br />17. Has the Forest Service approved removal of the <br />lamphouse at the Rock Tunnels portal, the electric power lines <br />to the Rock Tunnels lamphouse, and road work from Coal <br />Preparation Plant area to the lamphouse?
