extensive contamination is discovered than anticipated, the <br /> Division will alert the Creditors' Trustee and the CDPHE. <br /> The proposed scope of work is to excavate the <br /> contaminated soils and remove them to a facility licensed for <br /> disposal of such materials . The scope of work by component <br /> and cost is contained in the Division' s January 23 , 1998 <br /> submittal titled Estimated Reclamation Costs by Anticipated <br /> Project . <br /> Objection: As to that portion of interrogatory <br /> referring to the term Reclamation Plan, please see the <br /> Division' s general objection to the Defendants' definition of <br /> this term. As defined by the Defendants in the <br /> interrogatories, "reclamation plan" excludes many portions of <br /> the approved permit and, therefore, excludes many reclamation <br /> commitments and requirements . The Division' s response may <br /> include references to reclamation requirements contained in <br /> other portions of the approved permit : <br /> Volume 8 Chapter V Section <br /> As defined in the interrogatories, the term (MLRB) <br /> Reclamation Bond is defined as the security or pledge posted <br /> by Mid-Continent Resources . This document is a Deed of Trust <br /> regarding a parcel of land referred to as the Limestone or <br /> Rock Dust Plant . This document does no discuss reclamation <br /> requirements or costs . The Division is therefore unable to <br /> answer the portion of this interrogatory regarding the <br /> comparison of reclamation costs or requirements to this <br /> instrument . <br /> Documents relating to these costs will be made available <br /> for inspection at a mutually convenient time at the Division' s <br /> offices in Denver and\or Grand Junction. <br /> 53 . In the DMG Reclamation Accounting, tree planting <br /> is a component . Please explain what work has been or is <br /> proposed in connection with tree planting by location, <br /> component and cost, where in the approved Reclamation Plan <br /> this work is the responsibility of MCR, and where this is <br /> covered in the Reclamation Bond? If this work is not covered <br /> by the approval Reclamation Bond, what is the authority for <br /> 32 <br />
