The Division admits that it has spent, and has proposed to spend, funds to <br /> accomplish steep slope revegetation, except that the Division is without knowledge or <br /> information sufficient to form a belief as to the meaning of the term "substantial sums" and <br /> therefore denies the same. <br /> 31. The Division denies the allegations in the first sentence of paragraph 31. As to <br /> the second sentence, the Division admits that it has spent $72,260 on steep slope revegetation <br /> and that it has recently taken bids for additional steep slope revegetation, except that because <br /> of the delays occasioned by the Third-Party Plaintiffs' allegations in this lawsuit, the <br /> Division will not be performing steep slope revegetation in 1998. <br /> 32 through 34. The Division denies the allegations in paragraphs 32, 33, and 34. <br /> THIRD CLAIM FOR RELIEF <br /> (Breach of Contract for Re-Revegetation) <br /> 35. The Division incorporates all of its previous responses in the Answer as if set <br /> forth in full. <br /> 36. The Division admits that it has reclaimed and revegetated roads that provide <br /> access to mine portals at Coal Basin. However, the Division is without knowledge or <br /> information sufficient to form a belief as to what the term "benches" means and to which <br /> roads the terms "certain" and "some" refer and therefore denies the same. <br /> 37. The Division admits it has done and intends to perform reclamation work on or <br /> near mine portal areas. However, the Division is without information and knowledge <br /> sufficient to form a belief as to which work the Third-Party Plaintiffs refer and to the <br /> meaning of the term "significant vehicle traffic" and therefore denies the allegations of <br /> paragraph 37. <br /> 38 through 40.
