The parties acknowledge that they are required to promptly notify the Court in writing <br /> if the anticipated length of trial changes. <br /> H. <br /> DISCLOSURE <br /> A. Rule 26(a)(1) Disclosure <br /> I. Defendants and Third-Party Plaintiffs, Mid-Continent Resources, Inc. <br /> And Louis M. LaGiglia, Creditors' Trustee under Bankruptcy Plan of Liquidation <br /> (collectively hereinafter "MCR"), served their initial disclosure certificate pursuant to <br /> Rule 26(a)(1), COLO. R. CIV. P., October 7, 1997. It disclosed prospective witnesses <br /> and persons who may have discoverable information, and it enumerated anticipated <br /> exhibits and made them available for inspection and/or copying at MICR counsel's office. <br /> A copy of MCR's disclosure statement is attached as xhibil-A to this Order. <br /> 2. Third-party Defendant, State of Colorado, Department of Natural <br /> Resources, Division of Minerals and Geology ("DMG") served its initial disclosure <br /> statement pursuant to Rule 26(a)(1) on October 7, 1997. It disclosed persons who may <br /> have discoverable information, enumerated potential exhibits which are available at <br /> DMG's Denver and/or Grand Junction office. A copy of DMG's disclosure statement is <br /> attached as F hib to this Order. <br /> B. Rule 26(a)(2) Expert Disclosure <br /> This trial will likely require expert witnesses. <br /> Expert Witnesses Qi 0 ) <br /> 1. MCR anticipates the need for at least two reclamation experts and possibly <br /> one other expert. DMG anticipates the need for at least one reclamation expert and possibl% <br /> one other expert. In addition, some of the information held by persons listed in response to <br /> Rule 26(a)(1) may include opinions based upon each indiv:dual's knowledge, skill, <br /> experience, training and education. The parties will identify and provide Rule 26(a)(2)(C) <br /> disclosures by March 19, 1999. The parties will identify any rebuttal witnesses and provide <br /> expert reports by April 16, 1999. <br /> Dispute: In the original Case Management Order ,he Court ruled upon a dispute <br /> bet��'een MICR and DMG regarding MCR's assertion in its initial disclosure that: <br />
