II <br /> DISCLOSURE <br /> A. Rule 26(a)(1) Disclosure <br /> 1. Plaintiffs, Board of County Commissioners of Pitkin County, <br /> Colorado and Thomas Carl Oken, Pitkin County Treasurer, served their initial disclosure <br /> certificate pursuant to Rule 26(a)(1) on October 8, 1997, disclosing persons who may <br /> have discoverable information, and making documents and tangible things, as applicable, <br /> available at the office of counsel for Plaintiffs. A copy of Plaintiffs' disclosure statement <br /> is attached as Exhibit-A to this Order. <br /> 2. Defendants and Third-Party Plaintiffs, Mid-Continent Resources, <br /> Inc. and Louis M. LaGiglia, Creditors' Trustee under Bankruptcy Plan of Liquidation <br /> (collectively hereinafter "MCR"), served their initial disclosure certificate pursuant to <br /> Rule 26(a)(1), COLO. R. Civ. P., October 7, 1997. It disclosed prospective witnesses and <br /> persons who may have discoverable information, and it enumerated anticipated exhibits <br /> and made them available for inspection and/or copying at MCR counsel's office. A copy <br /> of MCR's disclosure statement is attached as Exhibit-B to this Order. <br /> 3. Third-party Defendant, State of Colorado, Department of Natural <br /> Resources, Division of Minerals and Geology ("DMG") served its initial disclosure <br /> statement pursuant to Rule 26(a)(1) on October 7, 1997. It disclosed persons who may <br /> have discoverable information, enumerated potential exhibits which are available at <br /> DMG's Denver and/or Grand Junction office. A copy of DMG's disclosure statement is <br /> attached as Exhibit-C to this Order. <br /> B. Rule 26(a)(2)Expert Disclosure <br /> This trial will likely require expert witnesses. <br /> Plaintiffs'Experts <br /> 1. Plaintiffs anticipate the need for the following experts: <br /> a. An attorney to testify regarding attorney fees incurred by <br /> Plaintiffs in defending any frivolous and groundless claims <br /> of "MCR" and concerning the propriety of claims asserted <br /> to be frivolous and groundless. <br /> b. Plaintiffs presently do not anticipate retaining or specially <br /> employing any other witnesses to provide expert testimony. <br /> However, some of the information held by the persons <br /> listed in response to Rule 26(a)(1)(A) may include opinions <br /> 2 <br />
