Mr. Delaney has <br /> knowledge and information about the operations of MCR, its shut-down and the causes <br /> therefor, the reclamation permit issued by the Mined Land Reclamation Board ("MLRB") <br /> of the Colorado Department of Natural Resources and administered by the Division of <br /> Minerals & Geology ("DMG") of the Colorado Department of Natural Resources. Mr. <br /> Delaney is generally knowledgeable concerning the reclamation activities of the liquidator <br /> under the PLAIN. Mr. Delaney is knowledgeable concerning the real property title and <br /> ownership,including the severance of the surface ownership from the mineral estate, and <br /> location of MCR and the sales of real property that have occurred during the PLAN's <br /> liquidation process. Mr. Delaney is generally knowledgeable about the MCR sales efforts <br /> between MCR's shut-down on January 25, 1991 and its Chapter 11 bankruptcy filing <br /> February 12,1992.Mr.Delaney is generally knowledgeable about the bankruptcy processes <br /> and the transformation of the proceeding from a Chapter 11 reorganization into a <br /> liquidation.Mr.Delaney is familiar with the DMG take-over of reclamation activities in Coal <br /> Basin.
