In 1995 and 1996 N ICR sold certain of its Coal Basin real property to generate <br /> monies to pay creditors,including Pitkin County, in furtherance of the liquidation PLAN. <br /> These sale parcels are described in Answer Exhibit 5 112. 1-10, attached hereto and <br /> incorporated herein by this reference.In each instance and for each parcel described,Pitkin <br /> County's statutory lien for ad aZerem taxes was paid.Proceeds from the July 1996 sales were <br /> deposited into an escrow described in complaint paragraph 23 (complaint Exhibit L). <br /> 93. On April 29,1997 three additional sales of Coal Basin real property occurred. <br /> These conveyances were recorded April 30, 1997 as Receptions Nos. 403894, 403895 and <br /> 403896 in the office of the Clerk and Recorder, Pitkin County, Colorado. The real property <br /> is described in Answer Exhibit 5 pp. 11-12. <br /> 94. The proceeds from the foregoing April 29,1997 sales($46,215.00,$42,120.00, <br /> and $111,735.00) were, by "Amendment To Escrow Agreement", dated April 29, 1997, <br /> additionally deposited in the e=erow described in complaint paragraph 23 (complaint <br /> Exhibit L). A conformed reduction copy of the "Amendment To Escrow Agreement" is <br /> attached to this answer, marked as Answer Exhibit 6, and incorporated herein by this <br /> reference. The 1996 and pro-rated 1997 ad valorem taxes on these three conveyances were <br /> paid by Stewart Title of Aspen contemporaneously with the closing.The pre-1996 ad valorem <br /> taxes on the real property that was the subject matter of these three conveyances were paid <br /> earlier. <br /> 95.
