EXHIBIT B <br />ADDITIONAL CONDITIONS TO CONTRACT TO BUY AND SALE REAL ESTATE <br />TO WHICH THIS EXHIBIT IS ATTACHED <br />1. Additional Conditions Precedent to Closing: <br />(a) Seller shall cause survey to be prepared and delivered <br />within thirty (30) days from the date hereof disclosing <br />valid legal description, location of all easements on <br />property and that there are no encroachments or setback <br />violations and such survey shall be sufficient to cause <br />standard ATLA exceptions, generally shown as Paragraphs <br />1 through 5, Schedule B, Section 2 to be deleted. <br />Description on Title Commitment shall be conformed to <br />survey description, and recertified in the event of <br />change, and delivered to Purchasers within ten (10) days <br />after completion of survey. Purchasers shall have ten <br />(10) days after completion of survey, monumenting of <br />corners, and delivery of conformed Title Commitment, if <br />needed, to make a complete inspection of the premises, <br />excluding environmental assessment and audit procedures <br />described in Paragraph D below. <br />(b) An easement acceptable to Purchaser, to be delivered <br />before closing, for continuation of the use of storm <br />drainage facility discharging to the East into settlement <br />pond on property belonging to others. <br />(c) An Order from the United States Bankruptcy Court, Denver, <br />Colorado approving sale on the terms herein stated to be <br />entered within sixty (60) days from the date hereof. <br />(d) Receipt of environmental assessmen. t .: epor t from ENSR <br />generally conformable to ASTM standard including <br />description of investication performed and containing a <br />statement in substance that ENSR found no evidence of the <br />existence of underground storage tanks and found no <br />evidence of the presence of contaminats at levels that <br />would require remedial action be taken under applicable <br />environmental law. Or, if any such conta"*jnates are <br />found, then defining the same and recommending corrective <br />action to be taken. Following such corrective action, if <br />any, ENSR shall amend the report showing corrective <br />action when the same has been completed. <br />(f) Purchasers shall within twenty (20) days after receipt of <br />ENSR Report deliver written_ statement to Seller <br />specifying any environmental condition not acceptable to <br />Purchasers, whether listed in said Report or not. <br />
