Dear Mr. Johnson: STATE OF COLORADO Roy Romer Governor Recently, you asked me to search Garfield County records to verify that the Deed of Trust from Mid - Continent Resources, Inc. (MCR) to the State of Colorado- MLRB had been filed. I, along with Debbie Mulloy- DMG, made the trip to Glenwood Springs on 7/14/93. We were able to confirm that the original Deed of Trust had been filed on 12/11/84. In addition, we noted four filings of financial assignments from MCR to Sanwa Business Credit Corp., and a judgment against MCR in favor of Joseph E. Harker, et al. Attached, as you later requested, you will find copies of the pertinent documents associated with the Harker suit against MCR. I took the liberty of copying the complaint, answer, and judg- ment. Copy costs amounted to $7.00, 14 pages @ $.50 /page, a receipt is enclosed. As you will note, the Harker suit resulted from an admitted default on a promissory note for stock redemp- tion interests held by the complainants. The suit was filed on 2/21/87, with judgment rendered on 12/7/87. Our records indicate MCR submitted a new Financial Warranty on 11/30/89 to add the reclamation bond for M -82 -121, the limestone quarry, to their Deed of Trust for their coal reclamation bond.
