The Division reviewed the approved permit application and pertinent materials to ensure <br />compliance with the current Rules. The issues identified below require attention to <br />ensure compliance. Please submit a revision within 90 days responding to the following <br />issues, including the reclamation cost estimate in Section VI. <br />Rule 2.03.6 <br />Please submit revised permit page under Rule 2.03.6 to include Exhibit 1 -6, Permit <br />Area Legal Description, in the description on page 1 -7. <br />Rule 2.04.11(4) and 2.05.6(2 <br />The Federal and State listed species of concern may have changed since the <br />last Permit Renewal No. 5. Please review, and update as needed, information in <br />the permit relative to current State and Federal Threatened and Endangered <br />plant and animal species lists. If any updates are needed, please also update <br />potential impacts to current State and Federal T & E plant and animal species <br />lists. <br />:mr�•i:�.I U1 <br />1. Please submit a revised permit page under IV.H.3 Roads, page IV -31, to include <br />Map 25 and Map 26 referring to the maps for the alignment of interplant roads. <br />2. Map <br />83 was deleted by Technical Revision 60. <br />Rule 2.05.4(2)(b) <br />Attached is the reclamation cost estimate for the 2012 Deserado Mine Midterm <br />Review. The Division updated the reclamation cost estimate with 2011 costs. <br />This updated estimate total is $5,424,329.88. This estimate includes reclamation <br />tasks identified in the permit and includes costs for Minor Revisions 140 through <br />146 and 148; and Technical Revisions 67 and 68, the only revisions that have <br />included an increase in liability since the estimate was last updated with the 2009 <br />Permit Renewal (06 February 2009). This 2012 Midterm Review revised cost <br />estimate is $279,195.12 less than the current liability of $5,703,525.00. The <br />revised liability in the RN -5 estimate is $2,560.00 less than the current bond held <br />of $5,630,311.00. <br />There were no changes to the volumes, haul distances, etc. contained in the <br />Permit Renewal No. 5 Estimate. All of the cost increases are from increased <br />equipment and materials costs, with the majority of the decreases occurring <br />9 <br />
