of lubrication, transportation and delivery costs thereof, actually <br />paid for equipment and machinery rented from third parties. <br />H. Cost of the premiums for all insurance which Contractor <br />is required to obtain under Section VI of this contract or under <br />applicable law. <br />I. Permit fees for equipment, licenses, tests, costs of <br />defending claims not proximately caused by Contractor, and deposits <br />lost for causes other than Contractor's gross negligence. <br />J. Claims of third parties to the extent not compensated by <br />insurance or otherwise. <br />K. Minor expenses such as telegrams, long- distance telephone <br />calls, telephone service at the site, expressage, and similar petty <br />cash items. <br />L. Costs incurred in operating and maintaining mine entries, <br />roads, and facilities in compliance with any applicable law, rule, <br />regulation, or permit requirements, including pumping, ventilating, <br />snow removal, and snow shooting, all as Contractor reasonably deems <br />necessary. <br />M. Costs incurred by Contractor to refurbish and prepare the <br />Equipment for sale including paint and necessary parts and <br />reconditioning to accomplish the same in those instances in which, <br />based on its experience, Contractor believes the monies thus spent <br />will be recovered in the course of obtaining a higher sales price <br />for such Equipment. <br />IV. COMPENSATION OF CONTRACTOR. <br />A. Statements. Contractor, on or before the tenth (10th) of <br />each month, shall submit to Mid - Continent a statement showing in <br />detail all monies paid out, costs accumulated or costs incurred on <br />account of the Cost of the Work during the previous month, sales <br />during the previous month, and the amount of the Contractor's <br />commissions retained as herein described, less retainage as <br />described below. <br />B. Commissions. In addition to recovery of Costs of the <br />Work as herein described, paid out of the initial receipts from <br />sales of the equipment, Contractor shall retain from Net Sales <br />Proceeds compensation as follows: <br />1. Of the first One Million Dollars ($1,000,000.00) in <br />Proceeds, Contractor will retain fifty percent (50 %) and <br />to or on behalf of Mid - Continent fifty percent (50 %). <br />Net Sales <br />shall pay <br />Net Sales <br />and shall <br />(80 %) . <br />08/13/92(12) <br />2. On the next Two Million Dollars ($2,000,000.00) in <br />Proceeds, Contractor shall retain twenty percent (20 %) <br />pay to or on behalf of Mid- Continent eighty percent <br />- 8 - <br />
