2. Pit-inflow induced impact to surface-water rights will be
prevented by providing a replacement supply from the
surface-water distribution system. These rights
obtain water from springs and seeps which are not
completely supplied by surface-return flows.
3. Neither PCC's out-of-priority surface-water use
nor pit inflows have been determined to cause any
impact to the twenty-nine wells (Figure 2 , Table 8)
within two miles of the NUCLA and NUCLA EAST mining
areas. The screened interval and pump intakes of
these wells are too deep to be affected by mining.
The two shallowest wells closest to the pit will be
monitored, however, if permission is obtained from
the well owners.
Implementation of the augmentation plan requires
approval by the District Court of the following applications:
1. Change of Water Right: On approval, this will
change the water right associated with the 27 shares
of the Colorado Co-operative Company, from
irrigation, domestic, stock watering and municipal to
include industrial use by direct flow and storage.
