Construction Summary - Area No. 3 Haul Road. In accordance with Rule 4, Part 4.03.1(1)(d) <br /> of the Rules and Regulations of the Colorado Mined Land Reclamation Board pursuant to the <br /> Colorado Surface Coal Mining Reclamation Act 34-33-101 et. seq., I, James Gary Schlenvogt, <br /> hereby certify that the construction of Area No. 3 Haul Road was inspected by myself. I, <br /> James Gary Schlenvogt, am a 1975 graduate in civil engineering and I have been a <br /> Registered Professional Engineer in Colorado since October 17, 1980. From August 17 until <br /> August 25, 1987, I was on site and inspected this structure. <br /> The Area No. 3 Haul Road is the main haul road out of the Area No. 3 mine area. This <br /> certification covers approimately 180 feet of the haul road. This haul road was utilized <br /> in the 1970s and early 1980s for access to the Area No. 3 mine area and was closed in 1983 <br /> when the mine went into temporary closure. The road was reopened again in 1987 when <br /> mining began in this area. The only construction occurred when the topsoil was removed <br /> and the road was cut basically on grade in order to minimize disturbance. <br /> The purpose of my inspection and certification was to ensure proper construction of Area <br /> No. 3 Haul Road and to satisfy the requirements of Rule 4.03.1(1)(d) of the Colorado Mined <br /> Land Reclamation Division. <br /> To the best of my knowledge, based upon my professional expertise and to the extent <br /> possible, this haul road at the Nucla Mine was constructed in accordance with the prudent <br /> state-of-the-art of earthen construction. Further, the structure was constructed in <br /> compliance with the approved design, to the extent possible, as specified in Tab 13 of <br /> Peabody Coal Company's mine permit. Sediment and runoff control is provided by <br /> Sedimentation Pond 005. The haul road location and horizontal alignment is shown on <br /> Exhibit 12-2, Operations Plan. The vertical alignment is shown on the Figure 13-3, "Area <br /> No. 3 Haul Road - As-Built". Figure 13-1, Area No. 3 Haul Road, indicates a minor amount <br /> of fill embankment from approximately Station 1+20 to the disturbance boundary; however, <br /> when the road was constructed as indicated on Figure 13-3, with the grades going from 4.1 <br /> percent to 9.5 percent, instead of a continuous 10 percent grade, the fill was eliminated <br /> and the road was constructed on the pre-existing roadbed. This reduced the potential for <br /> settlement and created a stable roadbed. The road width is adequate for the anticipated <br /> low volume of traffic in this mine area. <br /> The road was constructed on grade after topsoil was removed; therefore, no density tests <br /> or proctors were required; however, the road appears to be adequately maintained by the <br />
