Compliance With Mine Plan N - Support Facilities Not On -site <br />R - Other N - Special Categories Of Mining <br />N - Processing Waste R - Topsoil <br />COMMENTS <br />This was a partial inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. Zach Trujillo with the Division and Jim Kiger with Oxbow Mining <br />accompanied me on the inspection. The weather was warm and sunny and the ground was dry. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />- Both sediment ponds were dry at the time of the inspection. Both ponds were well vegetated and stable and no <br />erosional problems were noted. <br />- The ditch along the entrance /haul road was clean at the time of the inspection. No down - cutting or erosional <br />problems were noted. <br />- The ditch along the south side of the coal stockpile area (by the coal fines pile) has some sediment in it but the <br />ditch was generally in good shape, with no erosional problems noted. <br />GENERAL MINE PLAN COMPLANCE: <br />- The Terror Creek Loadout is a loadout and coal processing facility only, The operator was receiving, processing <br />coal (crushing and sizing) and loading coal (there were several train cars waiting to be loaded but were not being <br />actively loaded at the time of the inspection). The operations at the Terror Creek Loadout were consistent with <br />what is approved in the permit. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.032(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />- The mine entrance /haul road is a paved road to the truck scale. This portion of the road was well maintained and <br />stable. The remaining portion of the haul road, from the truck scale, around a loop, to the truck dump and back to <br />the paved haul road, was also well maintained and stable.
