COLORADO DEPARTMENT OF HEALTH
Water Quality Control Division
Rationale - Page 2
Permit No. CO-0000213
FACILITY DESCRIPTION: '
Because the Nucla Mine has temporarily ceased operations, the permittee has
requested that the self-monitoring frequency for pH, oil and grease, and
flow be reduced from weekly to monthly during the period that the mine
remains inactive. The permittee has supplied 4 years of self-monitoring
data for outfall 001 and 006 (from 12/79 through 12/83) which show, except
for a single exception on 12/19/80, that compliance with effluent
limitations has been maintained. Outfalls 002, 003, 004, and 005 have never
discharged.
The Division will grant the permittee's request.
Peabody Coal will be required to notify the Division upon resumption of
active operations. When the mine goes active the self-monitoring frequency
for pH, oil and grease, and flow will automatically revert back to weekly.
Additionally, this permit will serve to incorporate Federal BAT (Best
Available Technology Economically Achievable) effluent guidelines into the
permit. An explanation of the applicable State and Federal guidelines
(including BAT) follows.
APPLICABLE RULES AND REGULATIONS:
Table 1 below shows State Effluent Standards (SES), Federal Best Practicable
Control Technology (BPT), Federal Best Available Technology Economically
Achievable (BAT), and State Water Quality Standards (WQS) applicable to this
facility.
Table 1
Parameter SES BPT BAT WQS
pH, s.u. a/ 6.0 - 9.0 6.0 - 9.0 N/A 6.5 - 9.0
Oil and Grease, mg/1 a/ 10.0 N/A N/A N/A
Total Suspended Solids, mg/1 30/45 d/ 35/70 b/ c/ N/A N/A
Total Iron, mg/1 N/A 3.5/7.0 b/ c/ 3.5/7.0 N/A
Settleable Solids, ml/1 c/ N/A N/A 0.5 N/A
a/ This parameter applicable at all times
b/ This limitation applicable to discharges during periods of no preciptitation
c/ This parameter applicable to discharges during periods of precipitation less
than or equal to the 10-year, 24-hour event for this facility
d/ This limitation does not apply pursuant to Section 10.1.3(3) of the State
Regulations for Effluent Limitations
7-6-29
