2.03.7(2) LEGAL AND FINANCIAL COMMITMENTS. Peabody Coal Company entered
into a Coal Supply Agreement with Colorado-Ute Eltctric
Association, Inc. on December 9, 1974. By this agreement,
Peabody Coal Company has agreed to sell Colorado-Ute 1 ,500,000
tons of coal , an option to buy an additional 500,000 tons over
the life of this contract. The total contractual obligation
was 2,000,000 tons.
In 1983, Nucla Mine went into temporary cessation when the
Colorado-Ute Nucla Station was shut down. With the retrofit of
the Nucla Station to a fluidized bed combustion process ,
Colorado-Ute is letting bids for coal supply, which Peabody
Coal Company is actively pursuing to supply from the Nucla
Mine.
