State Reg. <br /> 2.03.7 IV. Relationship to Areas Designated Unsuitable for Mining <br /> 2.03.7(1) UNSUITABLE DESIGNATION STATUS. Peabody Coal Company has made a <br /> determination under the criteria set forth in Section 7.05 that <br /> no lands be designated unsuitable for mining at the Nucla Mine. <br /> In order to make this determination, Peabody Coal Company had a <br /> number of surveys conducted on the proposed mining area . <br /> 1. "A Final Cultural Resource Inventory Report of the Peabody <br /> Nucla Coal Mine in South Central Montrose County North of <br /> Nucla, Colorado" . (Volume 1, Tab 5) . <br /> 2. Geology of the Nucla Mining Are, (Volume 1, Tab b) . <br /> 3. Hydrology of the Nucla Mining Area (Volume 1, Tab 7) . <br /> 4. "Vegetation Baseline Study Nucla Mine" (Volume 1, Tab 10) . <br /> 5. Fish and Wildlife Baseline Study Nucla Mine (Volume 1 , Tab <br /> 11) . <br /> Furthermore, the Colorado dined Land Reclamation Division , in <br /> the "The Nucla Mine (C-008-81) Proposed Oecisiun and Findings <br /> of Compliance" , January 1983, fount; that "no Alluvial Valley <br /> Floors exist in either the mine area or the potentially <br /> affected area associated with Nucla Mine. '' <br /> Peabody is unaware of the availability of any inforoation which <br /> indicates that any portion of the Nucla Mine property has been <br /> or is under consideration or study for designation as lands <br /> unsuitable for mining. <br /> 3-19 Qvined 10 <br />
