the aforesaid requirement for exercising reasonable <br /> diligence to resume mining shall riot require Lessee to <br /> accede to any demand or position of any other party involved <br /> in such strike , lockout or industrial dispute . Lessee shall <br /> not be responsible for Royalty payments during cessation of <br /> activities as a result of the above causes . <br /> 17 . Removal Of Improvements And Installations . Buildings , <br /> fixtures , machinery , other equipment and of er installations <br /> or improvements maintained by Lessee on the Property , <br /> whether or not affixed to the Property , shall be and remain <br /> the property of Lessee . Lessee shall have the right for a <br /> period of One Hundred Eighty ( 180) days after termination or <br /> expiration of this Lease to remove all of its personal <br /> property , fixtures or any and all other property of <br /> whatsoever nature belonging to Lessee from the inside of any <br /> existing coal mine , or from the surface of any of the <br /> Property . Lessee shall further have the right for a period <br /> of One Hundred Eighty ( 180) days after termination or <br /> expiration of this Lease to remove any coal that may be <br /> stockpiled , upon proper payment or accounting for royalties . <br /> 18,. Notices . Routine or regular periodical reports , statements <br /> and payments hereunder shall be deemed to have properly been <br /> delivered when deposited in the United States mail . All <br /> formal notices of surrender , cancellation , default , <br /> termination or change of address shall be deemed to have <br /> been properly given when deposited in the United States mail <br /> as registered or certified mail , postage prepaid , and <br /> addressed to the party concerned at the address set forth <br /> above or such other address as shall be designated by either <br /> of the parties hereto by proper notice thereof to the other <br /> party or parties thereof concerned . <br /> 19 . Miscellaneous Provisions . Lessor hereby releases and waives <br /> all rights under and by virtue of the homestead exemption <br /> laws of Colorado , insofar as the same may in any way affect <br /> the purposes for which this Lease is made . <br /> 20 . Assignment . Rights hereunder may be assigned by Lessee to <br /> Third-parties without the consent of Lessor . This Lease and <br /> all the terms , provisions and conditions hereof shall be <br /> applicable to and binding upon and the benefits shall inure <br /> to the parties and their respective successors and assigns . <br /> This instrument constitutes the entire agreement between the <br /> parties and no modifications thereof or additions thereto shall <br /> be binding upon either of the parties until and unless a <br /> memorandum to such effect shall have been signed by all of <br /> the parties concerned . <br />
