Legal , Financial and Compliance Information <br /> 1 . Pursuant to Rule 2.03.4(1 ) and (5), the application will need to include <br /> a complete listing of the names and addresses of all owners and lease <br /> holders of surface and minerals within the permit area and owners of <br /> record of all surface and subsurface areas contiguous to the permit area, <br /> keyed to the surface and coal ownership maps. Lease documents containing <br /> the names and addresses could be referenced in the text if desired, but <br /> the documents would need to be labeled for inclusion as appendices to the <br /> application. <br /> 2. Pursuant to Rule 2.03.4(7), the application will need to include a <br /> statement of all lands, interest in lands, options or pending bids on <br /> interests held or made by NKC for lands which are contiguous to the <br /> proposed permit area. The information will be held confidential by the <br /> Division if so requested, if the requirements of Rule 2.07.5 are met. <br /> 3. Compliance information as required by Rule 2.03.5 will need to be updated <br /> to address any violations received since issuance of the permit renewal <br /> in 1987. <br /> 4. Lease documents upon which legal right of entry is based will need to be <br /> referenced in the text of the application, as required by Rule 2.03.6(l ). <br /> 5. The statement in the cover letter to the January 24, 1990 submittal <br /> indicating that Rule 2.03.7 (Relationship to Areas Designated Unsuitable <br /> for Mining) is not applicable for private leases is not correct. It <br /> would be correct to state that no portion of the proposed permit area is <br /> within an area designated unsuitable for surface coal mining operations <br /> under Rule 7 or 30 CFR 764 and 765 or under study for designation in an <br /> administrative proceeding under Rule 7 or 30 CFR 764 and 765. A <br /> statement to this effect should be included in the appropriate section of <br /> the permit application. <br /> 6. The revised application should include a discussion of projected time <br /> frames for initiation and completion of mining within the revision area, <br /> as well as the projected sequence of operations as required by <br /> Rule 2.03.8(2) . <br /> -1 - <br />
