Summary <br /> The Review Process <br /> The Division received a complete permit revision application addressing <br /> incorporation of the 60 acre coal lease modification into the permit area on <br /> April 6, 1989. Certain adequacy issues were discussed with NKC <br /> representatives at that time and a letter addressing additional concerns was <br /> sent to NKC by the Division on May 11 , 1989. Notice of availability of the <br /> application for public review was published for four consecutive weeks in the <br /> Durango Herald, beginning April 10, 1989. Narrative information and maps <br /> submitted by NKC on May 17, 1989 addressed final adequacy concerns raised by <br /> the Division, resulting in the proposed decision to approve the revision <br /> application. <br /> Description of the Environment <br /> Please see July 9, 1987 Findings of Compliance. <br /> Description of the Operation and Reclamation Plan <br /> The revised permit area encompasses approximately 409 acres, all of which are <br /> privately owned. Approximately 9.28 acres have been disturbed with no further <br /> surface disturbance anticipated. The 60 acre modification to Federal <br /> Lease C-29125 is immediately adjacent to and southwest of the original permit <br /> area within the S 1 /2 NE 1 /4 SE 1/4 SE 1 /4 Section 31 , Township 35N Range 11W, <br /> New Mexico Prime Meridian. <br /> Mining techniques, annual coal production and anticipated life of mine are <br /> unchanged from those described in the July 9, 1987 Findings of Compliance. <br /> The reader is referred to that document for a more detailed description of the <br /> operations and reclamation plan. <br /> -3- <br />
