Please ensure that the <br />name(s) given on the map are consistent with the names provided in the text. <br />All parts of this item have been resolved with the exception of parcel 49, which is still <br />listed in the Section 2.03.4(7) Oil, Gas and Mineral ownership for contiguous parcels. <br />Please reprove parcel 49 from the list. Item resolved in Dee-2011 response. <br />c) For both Surface and Oil, Gas and Minerals sections of 2,03.4(7), a listing of lessees has <br />been provided. The rules do not require that this information be included. <br />The listing of lessees was deleted from the Oil, Gas and Minerals section of 2.03.4(7); <br />but still remains in the Surface section. Please delete the lists of lessees from the <br />Surface section of 2.03,4(7). Itetn resoh,ed zn fee -2011 response. <br />d) Tables at the bottom of Maps 2.03.4 -1 and 2.03.4 -2 identify several properties for <br />which WFC is the lessee. Several of the parcels listed appear to be those within the <br />New Horizon (NH2) permit area. Please remove lease information that does not pertain <br />to the NHN permit. <br />Lessee designation for the NH2 Mine parcels was not deleted as requested. On Map <br />2.03.4 -1, please delete the Surface Lessee entries for parcels 1, 41 and 43. On Map <br />2.03.4 -2, please delete the Minerals Lessee entries for parcels 41 and 42. Item resolved <br />in Dee-2011 response. <br />7. Subsection 2.03.4(9) Applicant's interests in lands contiguous to permit area <br />The permit lists three land owners with whom WFC is discussing future alining of their <br />properties. In addition to the names, please provide the map designation numbers for each <br />property involved. Itent r°e solied in Alay -2011 response. <br />2.03.5 Compliance Information <br />During 2010, the applicant was issued two separate violations by the Division. Please revise <br />the Compliance Information section to include violations CV -2010 -002 and CV- 2010 -003. <br />Item resolved in Alay- 2011 response. <br />2.03.6 - Right of Entry and Operation Information <br />The first sentence of Subsection 2.03.6(1) requires that the application contain a complete <br />and detailed legal description of the proposed permit boundary. <br />a) A legal description of the permit area has been provided, but it appears in the <br />application as Attachment 2.03.8 -1, using numbering which is incongruous with the <br />rules. Please rename the legal description as Attachment 2.03;6 -1, and include a brief <br />description of the permit area in the text, e.g. "the area to be mined consists of three <br />parcels located in the W '/z of Section 25, bounded by Montrose County Roads Z, 26.00, <br />AA; and 26.50 ... the permit area also includes an equipment: corridor connecting the <br />NHN permit area to the New Horizon Mine permit area, crossing lands own by <br />WFC... <br />
