PRPA has an Agreement dated August 10, 1978 for Reuse of Water for Energy <br />Generation with the City of Fort Collins ( "Fort Collins ") and Water Supply and Storage Company <br />( "WSSC "). PRPA, Fort Collins, and WSSC also obtain approval of a plan for augmentation including <br />reuse of water in case no. W- 9322 -78. This water right was decreed in case no. W- 9322 -78 as <br />developed water, not tributary to the South Platte River. The Court found that 4,200 acre -feet, or <br />more per year will be available from Fort Collins to the PRPA to be used primarily for cooling <br />purposes in connection with its Rawhide Energy Station. Pursuant to the decree in case no. W- <br />9322-78 if PRPA does not require the water for its own purposes, it or Fort Collins or other water <br />users designated by it may utilize the water for any other beneficial purposes including <br />augmentation. In addition, PRPA has entered into an Agreement with the North Poudre Irrigation <br />Company ( "North Poudre") dated November 15, 1979 which grants PRPA the right to store surplus <br />water (which is surplus water beyond the needs of the Rawhide Energy Station) in the Fossil Creek <br />Reservoir and lease such water to others who can use such water from Fossil Creek Reservoir <br />through direct delivery. <br />At this time, the Applicant is expecting that a PRPA lease will not be required for 2012. However, <br />should the Boyd & Freeman augmentation station not be installed as assumed, then Aggregate <br />may seek a lease from the PRPA. Information regarding additional leases must be provided to the <br />SEO prior to the use of the water. <br />2012 projected yield may vary from previous estimated of the net yield due to the computed return flow obligations based <br />on the previous year's actual water deliveries. <br />Smith & Emmons Ditch <br />Aggregate owns 1.5 of 8 total outstanding shares in the Smith & Emmons Ditch Company. The 1.5 <br />Smith & Emmons Ditch shares were historically used to irrigate 68 acres of pasture grass. Using a <br />Blaney - Criddle analysis the potential crop consumptive use for the 68 acres was determined to be <br />108.7 acre -feet. Assuming a 10% ditch loss and 55% farm efficiency the dry year consumptive use <br />was determined to be 91.65 acre -feet. <br />The applicant may only utilize the 1.5 shares of Smith & Emmons Ditch at such time as all required <br />measurement and bypass structures have been installed and approved by the water commissioner. <br />Applicant does not expect this to occur during the duration of this SWSP. <br />Leggett -Owens Reservoir <br />Donald J. Sherwood owns 19.6 shares of the Leggett -Owens Ditch and Reservoir Company, which <br />Aggregate may use for augmentation pursuant to the mining lease agreement. During an average <br />year the 19.6 shares represents 60 acre -feet of water and can be released when needed. The <br />consumptive use credit available from the 19.6 shares is estimated at 33 acre -feet, based on a 55% <br />efficiency. <br />
